These Terms of Use ("Terms") govern your access to and use of the ecrew.com website and any E-Crew services that link to these Terms (collectively, the "Site"). These Terms supplement, and do not replace, any separate written agreement between you and E-Crew. By accessing or using the Site, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Site.
The Site is provided for your internal business or personal, lawful use only. Except as expressly permitted, you may not copy, distribute, sell, modify, or commercially exploit any content on the Site. You may view and download portions of Site content solely for internal, lawful purposes; any other use may violate copyright and other laws.
All images and frames submitted to E-Crew for annotation must be raw, unmodified captures. You may not combine, stitch, composite, mosaic, tile, or otherwise merge multiple images into a single image, and you may not submit images that have been so combined. Each submitted frame must be a single, original, unaltered image as produced by the capturing device. E-Crew may reject, without refund of credits consumed in detection, any submission that violates this requirement, and repeated violations may result in suspension or termination of your account.
You agree not to: (a) reverse engineer, decompile, or disassemble any portion of the Site; (b) attempt to gain unauthorized access to the Site, other users' accounts, or E-Crew systems; (c) scrape, spider, or harvest data, email addresses, or other information from the Site; (d) send spam, spoofed, or fraudulent communications through the Site; (e) flood, overload, damage, or interfere with the Site or its infrastructure; (f) trace or seek information about other users; (g) upload content you do not have the rights to upload, or content that is unlawful; or (h) violate any applicable law or assist anyone else in doing so.
All Site content — including graphics, code, design, trademarks, media, and the overall "look and feel" — is owned by or licensed to E-Crew, which retains all rights not expressly granted. You may not remove any proprietary notices, or rent, sell, sublicense, or redistribute the Site or any of its features. You retain ownership of images you upload; you grant E-Crew a limited license to process them solely to provide the annotation services you request.
Our Privacy Policy is incorporated into these Terms. If you submit another person's contact details to us, you represent that you have all rights and permissions necessary to do so, and you accept responsibility for that submission.
We have no obligation to provide updates to the Site or to maintain any particular feature. Downtime may occur, and we do not guarantee any minimum availability. We attempt to keep Site information accurate but do not guarantee it, and we reserve the right to correct errors, including pricing and numeric errors.
Any feedback you submit is non-confidential. You grant E-Crew a perpetual, royalty-free, fully paid-up, irrevocable, transferable, worldwide license to use feedback for any purpose without compensation or notice, and you represent that you have the rights necessary to provide it.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, E-CREW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. We do not promise uninterrupted service, that errors will be fixed, or that the Site is free of viruses or other harmful components. Your sole remedy if you are dissatisfied with the Site is to stop using it. E-Crew may suspend or terminate your access at any time without liability. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
You agree to indemnify, defend, and hold harmless E-Crew, its licensors, personnel, and other users from and against all losses, liabilities, and costs (including reasonable attorneys' fees) arising from your use of the Site, your breach of these Terms, your violation of law, content you provide, or related activity.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, E-CREW WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES (INCLUDING PERSONAL INJURY, LOST PROFITS, OR LOSS OF DATA). E-CREW'S AGGREGATE LIABILITY FOR DIRECT DAMAGES IS CAPPED AT FIFTY DOLLARS ($50.00). Any claim relating to the Site must be filed within one (1) year of the event giving rise to it or it is permanently barred. Jurisdictional exceptions may apply.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You submit to the exclusive jurisdiction and venue of the state and federal courts located in California.
These Terms, together with the Privacy Policy, are the entire agreement between you and E-Crew regarding the Site. A delay in enforcing any provision is not a waiver. You may not assign these Terms; E-Crew may assign them freely.
If any provision of these Terms is held invalid, that provision is severed and the remaining provisions remain in full effect.
The Site is operated from the United States. Access from jurisdictions where its content is illegal is prohibited, and users outside the U.S. are responsible for compliance with local law.
We may modify these Terms at any time. Changes take effect when posted to the Site.
